SUMMARY:An In-Depth Workshop on Accommodating Chronic\, Episodic\, and Dynamic Disabilities: Current medical science and practical solutions
DESCRIPTION:Program OverviewDesigned for management\, union participants\, and legal practitioners alike\, attendees will hear from leading experts and work in small groups on skill-building exercises. \nAttendees also have the option to attend our featured conferences at the same venue. Bundle pricing is available. \nWhat to Expect: \nIn this full-day workshop\, an experienced facilitator\, along with employer and union representatives\, will guide participants through a facilitated discussion and interactive exercises. \nAttendees will be encouraged to ask questions and engage with other participants. All participants also receive a comprehensive set of digital materials\, including textbook chapters\, case summaries\, and additional resources compiled by Lancaster House program lawyers for continued learning and reference. \nWho Should Attend \nThis workshop is ideal for: \n\nHuman Resources (HR) Managers and Directors\n\n\nUnion Officers and Representatives\n\n\nLegal Practitioners\n\nLabour Arbitration and Policy Skills Training WorkshopThis workshop examines the latest information surrounding chronic\, episodic\, and dynamic disabilities and what it means for workplace accommodation in practice. Participants will explore practical strategies for navigating complex accommodation requests and evolving medical information requirements and practices. Specifically\, the workshop will address: \nPart I – Understanding the science \n\nWhat is an episodic disability? What is a dynamic disability\, and how do they differ? How do these contrast with disabilities with more stable or non-fluctuating limitations?\nWhat does medical science tell us about fluctuating mental health disabilities such as bipolar disorder and schizoaffective disorder? What does medical science tell us about physical disabilities that can involve significant fluctuations in symptoms and functioning such as lupus and rheumatoid arthritis (RA)?\n\nPart II – Rethinking accommodation \n\nDo traditional accommodation models adequately address disabilities where an employee’s functional capacity changes over time? How can workplaces build flexibility into their workplace practices so that they can better adapt to changing needs?\nWhat happens when an employee discloses an episodic or dynamic disability only after attendance\, performance\, or conduct concerns have arisen? How should the employer respond?\nWhat information can employers legitimately request about an employee’s condition and anticipated absences?\nWhat happens when medical information is incomplete\, inconsistent\, or keeps changing? How should employers respond when medical documentation evolves\, different health-care providers provide different information\, or an employee’s condition does not follow the expected trajectory?\n\nPart III – Practical Accommodation \n\nWhen does flexibility become an accommodation and when does it become unworkable? How should employers approach flexible scheduling\, remote work\, modified duties\, intermittent leave\, reduced hours\, attendance flexibility\, and other arrangements for employees with dynamic\, chronic\, and episodic disabilities?\nHow should employers and unions monitor an accommodation to determine whether it is working\, and when should the accommodation plan be revisited?\nWhat happens when an accommodation plan stops working? When circumstances change\, can an employer revisit or modify an existing accommodation\, and what does a proper reassessment process look like?\nHow can employers design attendance-management policies that appropriately account for episodic and dynamic disabilities? What input should unions have?\nHow do employers distinguish disability-related limitations from performance\, attendance\, or conduct issues? What should employers do when the two overlap?\n\nPart IV – Legal boundaries and difficult cases \n\nHow should employers approach concerns about safety\, reliability\, or workplace behaviour when they intersect with a disability?\nWhen should employers seek additional medical\, occupational\, or other expert input when accommodation\, safety\, or functional capacity is unclear?\nWhen does accommodation reach the point of undue hardship\, and what evidence is actually required to establish it?\nWhat does a genuinely collaborative accommodation process look like in difficult cases? How should employers\, employees\, unions\, medical professionals\, and counsel work together when there is disagreement about restrictions\, proposed accommodations\, or whether further accommodation is possible?\n\n\n\n\n\n\nTime\nSchedule\n\n\n\n\nBreakfast\n8:00 am – 9:00 am ET\n\n\nWorkshop\n9:00 am – 10:25 am ET\n\n\nMorning Break\n10:25 am – 10:40 am ET\n\n\nWorkshop\n10:40 am – 12:00 pm ET\n\n\nLunch\n12:00 pm – 1:00 pm ET\n\n\nWorkshop\n1:00 pm – 2:20 pm ET\n\n\nAfternoon Break\n2:20 pm – 2:35 pm ET\n\n\nWorkshop\n2:35 pm – 4:00 pm ET\n\n\nWorkshop Ends\n4:00 pm ET\n\n\n\n\nFood and BeveragesBreakfast and lunch to be provided\, with a variety of snacks and refreshments available during breaks.
