Workplace investigations, whether they are probing complaints of workplace harassment or other forms of workplace misconduct, require processes that are fair and effective. Procedural errors can be costly, resulting in irreparable harm to employees and reputational harm to employers.

Participants will leave this interactive session ready to:

  • Identify the necessary steps in an investigation
  • Decide who should lead the investigation, and whether an external investigator is required
  • Determine the appropriate mandate and scope of the investigation
  • Make sure investigations comply with applicable law
  • Ensure procedural fairness
  • Manage uncooperative and absent witnesses
  • Assess credibility and evidence
  • Address issues of confidentiality and privilege
  • Review comprehensive investigation reports

In order to avoid both the financial and human toll of inadequate investigations, it is important that human resources professionals, members of management, and union representatives become familiar with the essential elements of thorough, balanced, and effective workplace investigations.
